Purpose

These terms and conditions (hereinafter, the “Terms”) govern and establish the rules and procedures for the contest called “Trivia Crack 12-Year Anniversary” (hereinafter, the “Contest”).

Contest Organizer

The organizer of the Contest is ETERMAX S.A., with registered address at Dr. Luis Bonavita 1294, Office 1701, Montevideo, Uruguay (hereinafter, “ETERMAX”). The Contest is not sponsored, administered, or associated in any way with the platforms on which it will take place.

Acceptance of the Contest

Any natural person who participates in the Contest (the “Participant”) expressly accepts each and every provision set forth in these Terms, as well as ETERMAX’s Terms of Service and Privacy Policy, available at http://www.etermax.com/en/terms/ and http://www.etermax.com/en/privacy/.

Term

The Contest will run from November 18, 2025, until December 15, 2025, at 00:00 (UTC-3), or until 1,000 comments are reached on the Post, whichever occurs first. The maximum duration cannot be extended beyond December 30, 2025.

Eligibility

To be considered a Participant and eligible to take part in the Contest, individuals must meet all of the following requirements at the time of participation:

• Be of legal age according to their state or country of residence.
  
• Have an active user account on the latest version of the mobile application “Trivia Crack” (the “App”).
  
• Follow the Instagram accounts @TriviaCrack and @Preguntados.
  
• Post one or more valid comments on the Post, provided such comments comply with platform policies and do not include offensive, illegal, discriminatory, defamatory, or otherwise inappropriate content.
  
• Have accepted and comply with these Terms.
  

Not eligible to participate:

• Any legal entity.
  
• Natural persons who do not meet the eligibility requirements.
  

Compliance with the Terms must remain valid throughout the entire duration of the Contest and until the delivery of the Prizes. Fulfillment will be verified by ETERMAX, and each Participant or Winner must provide any truthful and timely information requested. ETERMAX may, at its sole discretion, exclude any Participant at any time who fails to comply with these Terms or acts in bad faith, fraudulently, or contrary to the spirit of the Contest.

If, for any reason, ETERMAX allows a Winner to partially or imperfectly comply with the requirements when participating or claiming a Prize, such tolerance shall not imply a waiver of ETERMAX’s right to demand full compliance.

Participants agree that ETERMAX may publish their public data shared within the App (e.g., username, profile picture, progress, etc.) as well as their ranking within the Contest on its official social networks, in accordance with its Privacy Policy.

Participation in the Contest does not entail any direct or indirect obligation to purchase or hire any product or service.

Contest Mechanics

Participants who meet the requirements must post one or more comments on the collaborative Instagram post published by @TriviaCrack and @Preguntados (the “Post”). Comments must come from a personal and authentic account and may not originate from automated, duplicate, or participation-only accounts. The more comments and interactions Participants make, the higher their chances of becoming a Winner.

Prizes will be awarded progressively once the following comment milestones on the Post (each a “Milestone” or “Milestones”) are reached:

• Milestone 1: 90 comments
  
• Milestone 2: 200 comments
  
• Milestone 3: 400 comments
  
• Milestone 4: 600 comments
  
• Milestone 5: 1,000 comments
  

Upon reaching each Milestone, all comments posted by Participants up to that moment will be reviewed, and the Participant with the highest number of comments will receive the corresponding Prize, as defined in Section 7 (the “Winner”). In case of a tie, the Winner will be the Participant who posted their first comment earlier, according to the chronological order shown by the platform. A Participant may only win once; therefore, once a Winner is selected at a Milestone, their comments will no longer be considered for subsequent Milestones.

If the Milestones are not reached during the Contest period, ETERMAX may, at its sole discretion, declare any pending Prizes void or modify the Milestones or award conditions, disclosing such modifications on its official social networks.

Winners will be announced exclusively through the Instagram accounts @TriviaCrack and @Preguntados and via private message to the Winner’s personal account. ETERMAX will not contact Participants through other accounts, profiles, emails, or direct messages and is not responsible for damages resulting from fraudulent communications by third parties.

If a Winner cannot be contacted or fails to respond within 7 calendar days after the communication, ETERMAX reserves the right to award the Prize to the next eligible Participant or declare it vacant. ETERMAX is not responsible for technical issues, blocking, message filtering, platform errors, or any other circumstance preventing contact with the Winner.

Employees, partners, contractors of ETERMAX, its affiliates, commercial partners, and their immediate family members (parents, children, siblings, or spouse) are not eligible.

Prizes are non-transferable and may not be exchanged for cash.

“Booster” and “No Ads” Prizes will be credited directly to the Winner’s App account within 15 business days after completing ETERMAX’s verification process. They have no monetary value and cannot be transferred to another account.

Amazon digital gift cards (USD) will be sent exclusively by email to the address provided by the Winner within 15 business days after verification.

ETERMAX is not responsible for, nor obligated to compensate, replace, or reissue a Prize if:

• The Winner cannot redeem the Gift Card due to regional or Amazon restrictions.
  
• The Winner provides an incorrect email address.
  
• The Gift Card expires unused.
  
• The Winner’s Amazon account has limitations.
  
• The Winner loses access to their account (Amazon or App).
  
• The Prize cannot be applied due to errors, technical issues, interruptions, or updates.
  
• The Prize is lost due to device, OS, or account changes.
  
• Third parties access the Winner’s account.
  

If a Gift Card cannot be used due to regional restrictions, the Winner may request—within 7 days of receipt—an alternative Prize of equivalent value, defined exclusively by ETERMAX.

Prize Delivery Process

The Winner of each Milestone will be contacted via private message from the official Instagram accounts @TriviaCrack or @Preguntados.

They will be asked to provide a valid email address and identity verification if required. For “Booster” and “No Ads” Prizes, additional information may be requested.

Once the information is received and verified, the Prize will be delivered within 15 business days.

A Prize is considered delivered once the email is sent (for Gift Cards) or the benefit is credited in the App (for “Booster” and “No Ads”), without further responsibility for its use.

ETERMAX will rely solely on the information visible from the official accounts @TriviaCrack and @Preguntados to determine Winners. Differences in how comments appear to other users will not be considered.

Unless prohibited by applicable law, accepting a Prize authorizes ETERMAX to use the Winner’s name, photo, image, voice, address (country and city), and testimonials in any medium or format, worldwide and in perpetuity, for commercial or advertising purposes without compensation or approval requirements.

Prize allocation is subject to full compliance with these Terms. Failure to comply results in automatic loss of the Prize.

The Prize is personal, non-transferable, and cannot be exchanged for another Prize or service. It may only be claimed by the Winner, who must prove identity as required.

ETERMAX and its partners, employees, contractors, and affiliates are released from any liability for damages, losses, claims, or actions arising from participation in the Contest or acceptance of any Prize.

In case of force majeure preventing delivery of the original Prize, ETERMAX may substitute it with one of equal or greater value.

Use of Personal Data

ETERMAX will use Participants’ personal data to register them in the Contest, contact them, determine Winners, respond to inquiries, award Prizes, and publicly disclose Contest results for informational or promotional purposes. By participating, Participants expressly authorize this data processing.

Winners also authorize ETERMAX to disclose their username, country, and/or image on official channels without additional compensation unless prohibited by law.

ETERMAX may also use personal data in accordance with the App’s Terms of Service and Privacy Policy, and may share such data with affiliates and third parties.

Intellectual Property

The App and all its updates, revisions, modifications, and associated materials are the property of ETERMAX and are protected by intellectual property laws. Participation in the Contest grants no rights over the App or its content.

Participants retain ownership of any comments, texts, images, or content posted (“Participant Content”). However, by participating, they grant ETERMAX a free, worldwide, non-exclusive, indefinite license to use, reproduce, publish, adapt, and communicate such content for Contest-related or promotional purposes.

Participants declare their content is original, does not infringe third-party rights, and that they hold all necessary authorizations.

Other Conditions

ETERMAX may partially or fully modify these Terms, announcing the changes through its communication channels.
ETERMAX may cancel, postpone, or terminate the Contest at its sole discretion without generating rights or compensation for Participants.
ETERMAX may interpret any matters not expressly covered in these Terms at its sole discretion.

By participating, Participants and Winners acknowledge having read and accepted these Terms and ETERMAX’s Terms of Service and Privacy Policy and waive any claims against ETERMAX and its affiliates, partners, directors, or employees.

If any provision is declared void, the remainder will remain in effect.

For Participants residing in Uruguay or Argentina, these Terms are governed by the laws and courts of Argentina, specifically those of the City of Buenos Aires. For Participants residing elsewhere, they are governed by the laws and courts of Uruguay, specifically those of the City of Montevideo.
